The Zoning Board of Appeals and Zoning Variance Information

Planning and Zoning

The Zoning Board of Appeals serves as the judicial branch of Township government.  Its authority is outlined in the Michigan Zoning Enabling Act (Public Act of 110 of 2006, as amended).  

The duties of the Zoning Board of Appeals include:

1. Interpretation of the Zoning Ordinance text or map.  The Zoning Board of Appeals shall hear and decide requests for zoning ordinance text and map interpretation taking into consideration the intent and purpose of the Zoning Ordinance and the master plan. 

2. Appeal of administrative decisions.  The Zoning Board of Appeals shall hear and decide appeals where it is alleged there is an error of law in any order, requirement, decision, or determination made by an administrative official or body in the enforcement of the Zoning Ordinance.

3. Consideration of dimensional (non-use) variances.  The Zoning Board of Appeals shall review and consider requests  for dimensional variances where a literal enforcement of the provisions of the Zoning Ordinance would involve practical difficulties.  The Zoning Board of Appeals shall have the power in specific cases to authorize such variation.

4. Other specific duties associated with Zoning Ordinance non-conformities. The Zoning Board of Appeals has the authority  to determine whether a non-conforming structure may be enlarged, expanded, or extended.

The Zoning Board of Appeals meets in person in the Meeting Hall at the Township Hall on a monthly basis. The schedule of meeting dates is available on the ZBA webpage and here. The public may attend in person or virtually, using the methods described on the meeting agenda.
